Module Description: The aim of the module is to give learners an introduction to the operation of the Irish Legal System in a farming context, explore aspects of Business Law, Probate Law, Succession Law, Land Law and Regulatory Issues, and extract the provisions of Irish and International Law which impact upon Farmers.

On successful completion of this module the learner will be able to:

Irish Legal System and Legal Principles
Difference between criminal law and civil law; sources of law relevant to farming (Constitution/legislation/EU/international law); Principles of contract law.
Introduction to Land Law
Land Lease, Occupier’s Liability and Adverse Possession.
Structuring Your Farm Business
Sole Trader, Registered Farm Partnership, Succession Farm Partnership, Limited Liability Company, Collaborative Farming, and the legal concepts of separate legal personality and limited liability.
Introduction to Succession and Probate
Formal requirements of a valid will, rules governing intestacy, legal avenues to challenge a will, and enduring powers of attorney; Rules relating to CAT, Stamp Duty and Capital Gains Tax, and the reliefs available in respect thereof in a farming context.
Employment Law
Legal Obligations of Farmers who are Employers.

Re-assessment will be based on repeat coursework. This is at the discretion of the exam board contingent on the nature of the failed submission. The student the student may have to complete a number of components of the project or it may be requested to repeat and attend the module.
